DIRECT SELLING RULES – INCLUSION OF “NETWORK OF SELLERS” GIVES A BREATHER TO THE INDUSTRY

FDSA extends sincere thanks to the Government of India for acceding to the requests of the Direct Selling Associations to amend the definition of “Network of Sellers” in the DS Rules.

This amendment has done clear segregation of the genuine direct selling from money circulation. A much-needed breathing space is the life-line of the industry.

It was way back in 2011, FDSA, IDSA & FICCI struggled tirelessly for five years, resulting in the release of Direct Selling Guidelines 2016. Though the Guidelines had no legal status, but were an important intermediate stage towards the legal sanctity of the Direct Selling in India.

The DS Associations like FDSA, IDSA, ADSEI and FICCI etc., continued their struggle for an Act and made the Guidelines, a part of the Consumer Protection (Amendment) Act 2019 to give it a legal strength.

The Direct Selling Rules declared thereafter, in the year 2021, were an outcome of the collective efforts and unity of the DS Associations.

The omission of certain suggestion pertaining to the clarity between Direct Selling & Ponzi schemes posed a set-back to the industry. All the Direct Selling Associations once again pooled their strengths and succeeded in getting the “Network of Direct Sellers” inserted in the definition of DS Rules as an amendment.

The uncertainty on crores of Direct Selling Distributors is gone forever. The industry is thankful to the Government and the DS Associations for efforts made thereon.
